By accessing or using the Profit Zombies website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Profit Zombies provides digital marketing services including but not limited to social media advertising, Google PPC management, email marketing, text message marketing, website development, and related consulting services. Specific services, deliverables, and terms will be outlined in individual service agreements.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information necessary for service delivery
• Grant necessary access to advertising accounts, websites, and other platforms as required
• Respond to requests for approvals and feedback in a timely manner
• Ensure all content and materials you provide comply with applicable laws
• Pay for services according to the agreed-upon payment terms

4. Payment Terms

Payment terms are as follows:

• Payment is due according to the terms specified in your service agreement
• Late payments may result in service suspension or termination
• All fees are non-refundable unless otherwise specified in writing
• Advertising spend is separate from service fees and is the client's responsibility

5. Intellectual Property

Upon full payment, clients receive ownership of custom content, designs, and materials created specifically for their campaigns. Profit Zombies retains ownership of proprietary tools, methodologies, templates, and any pre-existing materials. We reserve the right to showcase completed work in our portfolio unless otherwise agreed in writing.

6. Results Disclaimer

Marketing results vary based on many factors including industry, competition, budget, and market conditions. While we strive for the best possible outcomes, we do not guarantee specific results, rankings, or return on investment. Any projections or estimates provided are based on our experience and are not guarantees.

7. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This includes business strategies, customer data, financial information, and any other sensitive materials.

8. Termination

Either party may terminate services according to the terms specified in the service agreement. Upon termination, client is responsible for payment of all services rendered up to the termination date. We will provide reasonable transition assistance and return of client materials.

9. Limitation of Liability

To the maximum extent permitted by law, Profit Zombies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the amount paid for services in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Profit Zombies from any claims, damages, or expenses arising from your breach of these terms, your content, or your violation of any laws or third-party rights.

11. Governing Law

These Terms shall be governed by the laws of the State of Florida without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Hillsborough County, Florida.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of the modified terms.
